Terms of Use — Flake Real Estate

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Flake Real Estate website, including any related mobile apps or services (together, the "Platform"), operated by Flake Real Estate ("Flake," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Description of Service

Flake provides an online platform for searching, viewing, and inquiring about residential real estate listings in Kosovo, including tools such as map-based search, saved searches, saved listings, valuation estimates, and communication with listing agents. Flake is a technology platform and, unless otherwise stated, does not itself act as a licensed real estate broker or agent in any individual transaction.

3. Eligibility and Accounts

You must be at least 18 years old to create an account on the Platform. When you register, you agree to provide accurate, current information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

Use the Platform for any unlawful purpose or in violation of these Terms;
Post false, misleading, or fraudulent listing information;
Scrape, copy, or systematically extract data from the Platform without our written permission;
Interfere with the security or proper functioning of the Platform;
Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
Use the Platform to send unsolicited advertising or spam to other users or agents.

We may suspend or terminate access for any account that violates this section.

5. Listings and Third-Party Content

Property listings, prices, photos, and descriptions displayed on the Platform may be submitted by agents, brokers, property owners, or other third parties, and may in the future be sourced in part from third-party data feeds. Flake does not guarantee the accuracy, completeness, or current availability of any listing. Prices, availability, and property details can change without notice, and you should independently verify any information before making a decision — including through direct contact with the listed agent and, where appropriate, a licensed professional (notary, lawyer, surveyor).

Valuation estimates and similar tools provided on the Platform are automated estimates for informational purposes only. They are not appraisals, and should not be relied on as the sole basis for any financial or purchase decision.

6. No Real Estate, Legal, or Financial Advice

Nothing on the Platform constitutes real estate, legal, tax, or financial advice. Flake is not a party to, and assumes no responsibility for, any transaction between a user and an agent, broker, landlord, or seller. Any agreement to buy, sell, rent, or lease property is solely between the relevant parties.

7. User-Submitted Content

If the Platform allows you to submit content (e.g., listing inquiries, tour requests, reviews, or notes within shared Collections), you retain ownership of that content but grant Flake a non-exclusive, worldwide, royalty-free license to use, store, and display it as needed to operate the Platform. You are solely responsible for content you submit and confirm you have the right to share it.

8. Intellectual Property

The Platform, including its design, logos, text, graphics, and underlying software, is owned by Flake or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Platform without our prior written consent, except as necessary to use the Platform for its intended purpose.

9. Third-Party Services

The Platform may integrate third-party services (for example, mapping providers, email delivery, or payment/scheduling tools). Your use of those integrations may be subject to the third party's own terms and privacy policy, which we encourage you to review. We are not responsible for the practices or content of third-party services.

10. Privacy and Cookies

Our collection and use of personal data, including through cookies and similar technologies, is described in our separate Privacy Policy and Cookie Policy. By using the Platform, you consent to the practices described in those policies.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Flake and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Platform, or from any transaction or communication with an agent, broker, or other user, even if advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold Flake harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Platform, your content, or your violation of these Terms.

14. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users or the Platform.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the Platform with a new "Last updated" date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the Republic of Kosovo, without regard to conflict-of-law principles. Any disputes arising from these Terms or use of the Platform will be subject to the exclusive jurisdiction of the competent courts of Kosovo, unless otherwise required by applicable law.
